• Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules
• The arbitration shall take place in Newtown, Pennsylvania, or any other location mutually agreed
• The arbitrator’s decision shall be final and binding
• Judgment on the award may be entered in any court of competent jurisdiction

3. Class Action Waiver

You agree that any dispute will be brought solely in your individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims, and may not preside over any form of representative or class proceeding.

4. Small Claims Exception

Either party may bring an individual claim in small claims court for disputes within the court’s jurisdiction, in lieu of arbitration.

5. Injunctive Relief Exception

We retain the right to seek injunctive or equitable relief in court for claims related to intellectual property, confidentiality, or unauthorized access to our systems.

6. Opt-Out Right

You may opt out of this Dispute Resolution & Binding Arbitration section by sending written notice to info@fiberinternetshop.com within 30 days of first accepting these Terms. The notice must include your name, address, and an explicit statement that you opt out of binding arbitration.

Severability

If any provision of these Terms is held unenforceable, the remaining provisions will continue in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
